1 Acceptance of Terms
These Terms of Service constitute a legally binding electronic agreement between you ("User", "Customer") and Foody Ashta Technologies Pvt. Ltd. ("Foody Ashta", "we", "us"). By accessing foodyashta.in or using our mobile applications, you confirm that you are at least 18 years old (or using the service under legal parental supervision) and agree to be bound by these terms.
2 Platform Role (Online Intermediary)
Foody Ashta operates as an online technology intermediary platform under Section 79 of the Information Technology Act, 2000. Foody Ashta facilitates transactions between customers, independent merchant restaurants, and independent delivery fleet partners. We do not manufacture or prepare food items ourselves; the respective culinary merchant is solely responsible for food preparation, hygiene, taste, and packaging compliance.
3 User Account & OTP Verification
- You must register using a valid, active Indian mobile telephone number.
- Account authentication is secured via One-Time Passwords (OTP). You are responsible for maintaining the confidentiality of any OTP sent to your registered device.
- Foody Ashta reserves the right to suspend or terminate accounts that provide fraudulent information or engage in abusive platform behavior.
4 Ordering, Pricing & Payments
Menu Prices & Taxes
Prices displayed are determined by partner restaurants and include applicable Government Goods & Services Tax (GST) as displayed in the checkout bill breakdown.
Payment Gateways
Payments are processed securely via RBI-compliant partner Razorpay (supporting UPI, Credit/Debit cards, Net Banking, and Cash on Delivery).
Promotional coupon codes are subject to minimum order value requirements, validity windows, and usage caps as stated in the respective coupon terms.
5 Delivery Terms & Customer Obligations
- Estimated delivery times are indicative and may vary based on weather, peak traffic, preparation time, and road conditions.
- Customers must ensure accurate address details, contact numbers, and entry instructions are provided.
- If the delivery partner is unable to contact you within 10 minutes of arrival at the destination address, the order may be cancelled with no refund entitlement.
6 Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
